§ 2-82. Employment of off-duty officers by establishments serving alcoholic beverages.

  • (a)

    Employees of the police department and fire department, during off-duty hours have in the past been employed by certain business establishments in the city and other cities holding licenses for on-premise consumption of alcoholic beverages. Such employees of the city in their employment capacity by such business establishments involved such employees wearing their uniforms as policemen or firemen of the city and given the impression to the public that such employees were acting in their official capacity as employees of the city while in such business establishments that were serving alcoholic beverages for on-premise consumption. Such employment practices involved the business establishment hiring such city employees who thought it would be most beneficial and sympathetic to such business establishment serving alcoholic beverages for on-premise consumption. Such arrangement and system as have existed in the past has led to abuses, have the potential to lead to abuses and presents to the public an image that the city condones such practices. Such practice also exposes the city to claims and lawsuits involving such off-duty personnel employed in a private capacity, who can by their action potentially expose the city to liability for their action in such a highly charged atmosphere and environment of consumption of alcoholic beverages.

    (b)

    The city, a municipal corporation, for the purposes of preventing future abuses, reducing its liability, enhancement of employee moral in the police and fire department and improving the image and removing any question that the city condones such business establishments, does henceforth and forever more provide that no employee of the city police department or fire department shall be employed during off-duty hours, either in or out of uniform by any business establishment serving alcoholic beverages for on-premise consumption.
